Eve Massage Services provides professional massage and wellness services, including but not limited to:

• Thai massage
• Full body massage
• Relaxation therapy
• Deep tissue massage
• Aromatherapy massage
• Hot stone therapy
• Lymphatic drainage
• Sports recovery massage
• Reflexology
• Herbal steam bath
• Pedicure and manicure
• Home service massage appointments
• Wellness consultations
• Specialist clinical therapies (stroke recovery support, diabetes support therapy)

Our services are primarily offered within Eket, Uyo, and surrounding areas in Akwa Ibom State, Nigeria. Home service is available across all of Akwa Ibom State.

Any users accessing the Services from other locations do so at their own discretion and are responsible for compliance with any applicable local laws.

Intellectual Property Rights

All content on this website, including but not limited to the EMS logo, text, service descriptions, website design, graphics, photographs, booking forms, source code, and branding assets, is the exclusive intellectual property of Eve Massage Services unless otherwise stated.

No part of the Services may be copied, reproduced, distributed, republished, or commercially exploited without our prior written permission.

User Representations

By using the Services, you represent and warrant that:

• You have the legal capacity to enter into these Legal Terms
• You are at least 18 years old, or have appropriate legal consent from a parent or guardian
• All information submitted by you is accurate and complete
• Your use of the Services will not violate any applicable law or regulation

Prohibited Activities

You agree not to engage in any of the following:

• Misuse the booking platform or submit fraudulent or false booking requests
• Harass, threaten, or intimidate EMS staff or therapists
• Attempt to gain unauthorised access to the website or its underlying systems
• Copy or reproduce content for commercial use without written permission
• Upload malicious code, viruses, or harmful files to any part of the Services
• Use the Services for any unlawful purpose

User Generated Contributions

The Services may permit users to submit booking requests, inquiries, comments, feedback, and reviews. By submitting such information, you confirm that:

• The information is truthful and based on your genuine experience
• It does not violate any applicable law
• It does not infringe any third-party rights

You remain solely responsible for the content you submit. EMS reserves the right to review, approve, or remove any user-submitted content at its discretion before it appears publicly on the website.

Contribution Licence

By providing feedback, reviews, inquiries, suggestions, or comments through the Services, you grant EMS the right to access, store, process, and use such information for business improvement and service delivery purposes. This licence is non-exclusive, royalty-free, and perpetual.

Booking & Cancellation Policy

Booking confirmation

All bookings are confirmed via WhatsApp or email by our team. A booking is only considered confirmed once you have received an explicit confirmation message from us. Submitting a booking request does not automatically constitute a confirmed appointment.

Cancellation by the client

Cancellation by EMS

In the event that EMS must cancel your appointment due to unforeseen circumstances (therapist illness, emergency, or force majeure), we will notify you as early as possible and offer you the earliest available alternative appointment or a full waiver of any fees paid.

Home service cancellations

For home service bookings, cancellations made after a therapist has already departed for your location may incur a transport cost charge. We will communicate this clearly at the time of cancellation.

Refund Policy

General refund position

As our services are delivered in person and in real time, refunds are not automatically available once a session has been completed. However, we assess each situation individually and aim to act fairly in all cases.

Circumstances where a refund or remedy may be offered

• The session was cancelled by EMS without reasonable notice
• The service delivered was materially different from what was agreed at booking
• A verifiable error occurred in our booking or payment process
• A client experiences an adverse reaction directly attributable to EMS negligence — subject to review

Circumstances where refunds will not be offered

• The client did not disclose a relevant medical condition prior to the session
• The client changed their mind after the session was delivered
• Dissatisfaction arising from a preference for a different therapist or technique, where the agreed service was delivered as described
• No-show or late cancellation as described in Section 7

How to raise a concern

If you are dissatisfied with your experience, we ask that you contact us within 48 hours of your session via WhatsApp at 09055853040 or email at evemassageservices@gmail.com. We will investigate and respond within 5 business days with a proposed resolution.

Services Management

We reserve the right to monitor the Services for misuse, restrict or suspend access where necessary, suspend bookings, remove unlawful or harmful submissions, and protect the integrity of the platform at our sole discretion.

Term and Termination

These Legal Terms remain in effect while you use the Services. We reserve the right to suspend, restrict, or terminate access to the Services at any time without notice where a breach of these terms occurs or is reasonably suspected.

Modifications and Interruptions

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice. We do not guarantee uninterrupted access and shall not be liable for downtime, delays, or temporary unavailability of any part of the Services.

Governing Law

These Legal Terms shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Legal Terms shall be subject to the exclusive jurisdiction of the courts in Akwa Ibom State, Nigeria.

Dispute Resolution

The parties agree to first attempt to resolve any dispute informally by contacting EMS directly and allowing a period of 30 days for good-faith negotiation. Where no resolution is reached within that period, the matter shall be referred to a court of competent jurisdiction in Akwa Ibom State, Nigeria.

Corrections

We reserve the right to correct any typographical errors, omissions, inaccuracies, service descriptions, pricing, or availability information at any time without prior notice. Updated pricing is always reflected on the Pricing & Booking page of our website.

Disclaimer

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Massage and wellness services offered by EMS are intended for relaxation and therapeutic purposes and are not a substitute for professional medical treatment or diagnosis.

Limitation of Liability

EMS shall not be liable for any injury, reaction, or adverse outcome resulting from:

• Undisclosed medical conditions or medications
• Failure to follow pre- or post-session care instructions
• Unsafe home service environments not disclosed or prepared by the client
• Inaccurate booking information provided by the client

Our total liability in any circumstance shall not exceed the amount paid for the specific session in question.

Indemnification

You agree to indemnify, defend, and hold harmless Eve Massage Services and its staff, therapists, and representatives from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services or breach of these Legal Terms.

User Data

We may collect and process personal information including your name, phone number, WhatsApp contact, email address, booking address, and service preferences for the purpose of delivering our services and communicating with you. All data is handled in accordance with our Privacy Policy.

Electronic Communications

By contacting us through the website, phone, WhatsApp, or email, you consent to receive communications from EMS including booking confirmations, reminders, and service-related updates. You may opt out of non-essential communications at any time by contacting us directly.

Miscellaneous

These Legal Terms constitute the entire agreement between you and Eve Massage Services concerning the use of the Services and supersede all prior agreements. If any provision is found to be unenforceable by a court of competent jurisdiction, the remaining provisions shall remain valid and enforceable in full.
